1.1 Joint Data Controllers

PickArt AG and PickArt Platform Ltd jointly operate the PickArt platform and services, including the use of cookies on this website. Both entities act as joint controllers for the processing of your personal data in accordance with applicable data protection laws (Swiss DSG, EU GDPR, and UK GDPR). 2. How We Use Cookies

PickArt (“we”, “us”, or “our”) uses cookies on our website (www.pickart.com) in accordance with the Swiss DSG, the EU GDPR, and the UK GDPR. We rely on legitimate interests and/or your consent, as required by applicable data protection laws, to use cookies for several purposes:

• Essential / Strictly Necessary Cookies: These cookies are essential for you to browse the website and use its features, such as accessing secure areas of the site (like user accounts) or processing transactions. Without these cookies, services like user login and payment processing cannot be provided. These may be set by our platform infrastructure (Vercel, Supabase) or payment processor (Stripe).
• Performance and Analytics Cookies: These cookies collect information about how you use our website, like which pages you visit most often, how you interact with the page, and if you get error messages from web pages. We use Google Analytics and PostHog for this purpose. PostHog may also record a replay of your on-page interactions (such as clicks and scrolling) to help us diagnose issues, with sensitive input fields masked.
• Marketing / Advertising Cookies: These cookies are used by our advertising partner, Meta (Facebook/Instagram), to measure the effectiveness of our ad campaigns and to show you more relevant ads on Meta's platforms. The Meta Pixel sets a cross-site advertising identifier and may match it against a hashed (irreversibly scrambled) version of information you provide us, such as your email address, for ad targeting and retargeting purposes.
• Functionality Cookies: These cookies allow the website to remember choices you make (such as your user name, language, or the region you are in) and provide enhanced, more personal features. For example, they might remember your login details (if you opt-in).

Strictly necessary cookies are used on the basis of legitimate interests as they are essential for site operation, while non-essential cookies require your consent.

We do not use cookies to directly collect personal information such as your name or email address unless you provide this information voluntarily through login, forms, or other interactions. However, we may link cookie data to personal information you have provided to improve your experience and our services.

2.1 Anonymous Analytics Without Cookies

Until you accept cookies, or if you decline them, we count your visit anonymously with PostHog, so that we can understand how many people visit our website and how they found it (for example, through one of our ad campaigns). This works without cookies:

• PostHog stores no cookies or similar identifiers on your device. It only saves a small note in your browser that you haven't accepted cookies, which contains no identifier.
• No session replay is recorded and no user profile is created. Your visit cannot be linked to you, and visits on different days cannot be linked to each other.
• To count unique visitors, PostHog's servers combine your IP address and browser information with a random value that changes every day and is then deleted. Your IP address is not stored.
• We only collect anonymous usage information, such as the pages you view, the website or campaign that referred you, your device type, where you click and scroll on a page, page loading performance, and technical errors.

We rely on our legitimate interest in understanding the reach of our website and campaigns for this processing. If you accept cookies, PostHog uses the cookie-based analytics described above instead.

2.2 How You Found Us

When you first visit our website, we set a first-party cookie (pickart_acq) that records how you found us: the first page you landed on, the website that referred you, and any campaign parameters in the link (such as utm_source). It contains no identifier and is kept for up to 90 days. We only use it if you accept cookies and later create an artist account, to understand which campaigns bring new artists to PickArt. If you decline cookies, it is deleted and not set again unless you accept cookies later.

3. Types of Cookies Used

• Session Cookies: These are temporary cookies that expire when you close your browser.
• Persistent Cookies: These remain on your device for a set period specified in the cookie or until you delete them manually. They are activated each time you visit the website that created that particular cookie.
• First-Party Cookies: These are set by the website you are visiting (PickArt).
• Third-Party Cookies: These are set by a domain other than the one you are visiting. This occurs when the website uses external services. On our website, third-party cookies may be set by:
  • Google Analytics and PostHog (for website analytics)
  • Meta (for advertising and retargeting, if you consent to marketing cookies)
  • Stripe (potentially during the payment process)
  • Vercel / Supabase (potentially for essential platform functionality or performance monitoring)
